Mediation/Arbitration (Med/Arb)

 

In the mediation/arbitration process, the parties engage in mediation. Any issues not resolved in mediation then go to arbitration where the neutral third party makes binding decisions. Binding decisions provide closure and certainty to both parties, unlike mediation which requires a voluntary agreement.

Resolutions reached in both mediation and arbitration are legally binding and enforceable, thereby ensuring compliance.

The more informal and collaborative nature of mediation and arbitration can reduce the emotional toll associated with family disputes. The process encourages constructive communication which can help maintain positive relationships post-dispute. This is particularly important if children are involved.
